DMCA & Copyright Policy

Effective date: August 14, 2026

WhereTheyPlay LLC ("WhereTheyPlay") respects the intellectual property rights of others and expects organizations and users of wheretheyplay.com (the "Service") to do the same. Consistent with the Digital Millennium Copyright Act (17 U.S.C. § 512), we respond to proper notices of alleged copyright infringement and will, in appropriate circumstances, terminate the accounts of repeat infringers.

Copyright and DMCA takedown notices should be directed to our designated agent, registered with the U.S. Copyright Office:

Submitting a takedown notice

If you believe content on the Service (for example, a photo on an organization's listing) infringes your copyright, send a notice to:

leads@wheretheyplay.com with the subject line "DMCA takedown notice"

Your notice must include all of the following (17 U.S.C. § 512(c)(3)):

  1. Identification of the copyrighted work you claim has been infringed.
  2. Identification of the material you claim is infringing, with enough detail for us to locate it (the listing URL and a description of the specific photo or text).
  3. Your name, mailing address, telephone number, and email address.
  4. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
  6. Your physical or electronic signature.

When we receive a complete notice, we will remove or disable access to the identified material promptly, notify the user who posted it, and record the strike against their account. Where the material is on a page WhereTheyPlay compiled itself and no user posted it, we remove or disable access the same way and record the notice against the page.

Counter-notices

If your content was removed and you believe the removal was a mistake or misidentification, you may send a counter-notice to the same address with the subject line "DMCA counter-notice", including: identification of the removed material and where it appeared; your name, address, and phone number; a statement under penalty of perjury of your good-faith belief the material was removed by mistake or misidentification; your consent to the jurisdiction of the federal district court for your address (or, if outside the United States, the Western District of Washington); your statement that you will accept service of process from the person who sent the original takedown notice, or from that person's agent; and your physical or electronic signature. If we receive a valid counter-notice, we may restore the material in 10 to 14 business days unless the original claimant informs us they have filed a court action.

Repeat infringers

WhereTheyPlay terminates, in appropriate circumstances, the accounts of users who are repeat infringers. Strikes from valid takedown notices are tracked per account; accounts that accumulate repeated valid claims will have their listings and accounts terminated as described in our Terms of Service.

Misrepresentation

Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees.
